this all echoes some of what silverglate is saying and he devotes some space in his book to looking closely at the andersen and martha stewart cases, etc.

the accounting fraud was based on expensing some sort of esop (employee stock options plan) in the footnotes of their reports and the document destruction is somewhat self explanatory

where the prosecution ran into problems: 

the "accounting method" of documenting in the foot notes was a rule endorsed/passed by the fasb/sec earlier i think there are sec members on the board and the head of the sec in an interview with pbr admitted that they should not have passed that rule

accounting fraud charge were based on hiding (in plain sight) these expenses in the footnotes (which was ironically based on their own rule)

second, every industry firm has a retention/destruction policy with documents and if we follow the timeline they ceased/stopped any and all destruction when they were notified by the feds

in other words they were operating within all guidelines/policy (which begs the question: if the feds originally thought andersen was complicit why didn't they have served them first or simultaneously?)

all of these accusations by the feds put andersen in an impossible "no win" situation

either testify against a client to fraud for the feds that wasn't fraud (which would obviously destroy their business) or face the wrath of getting indicted and a long, drawn out, expensive legal case (i think there are rules that if an accounting firm is under indictment that they have to basically cease business or maybe international business)

either way, the destruction of their reputation or being forced to freeze business, andersen was committing suicide they chose the legal route and eventually were vindicated, however the damage was already done (the client base was gone and the job destruction was enormous-roughly 28,000 employees, that went down to 200)

the problem is that overly aggressive prosecutors in their “pursuit of justice” have little or no culpability for the carnage they leave behind (silverglate says he is working on a follow up book with ideas on how to help correct the system)

where all of this might intersect and get interesting in the current case we see, is that the some of the same players in the andersen case are involved here and some of the methodology used may get trotted out and scrutinized

Weissmann’s team made sure they did not even get bail pending their appeals, even though the charges Weissmann concocted, like those against Andersen, were literally unprecedented.

Weissmann’s prosecution devastated the lives and families of the Merrill executives, causing enormous defense costs, unimaginable stress and torturous prison time. The 5th Circuit Court of Appeals reversed the mass of the case.

Weissmann quietly resigned from the Enron Task Force just as the judge in the Enron Broadband prosecution began excoriating Weissmann’s team and the press began catching on to Weissmann’s modus operandi.

Mueller knows this history.

You are so hopelessly stuck on Trump that I find it less and less worthwhile to engage in discussion with you. Why you still believe in Trump is beyond me. His attempts to gut health care and replace it with useless policies were a direct attack on the working and middle class. His tax "reform" saddled the US with $1.5 trillion more in debt so that he could give the top 0.1% the bulk of the tax cut benefits. He will try to gut Medicare, Social Security and other social welfare programs to pay for the tax cuts. That infrastructure plan he promised to create jobs for struggling areas is completely MIA. Those steel and aluminum tariffs he slapped down are costing Americans far more jobs than they're saving. 

Donald Trump is enriching the very richest people and is enabling some of the most corrupt individuals far more than Hillary Clinton could ever done. You and the people you care about are getting reamed by a narcissistic psychopath and you can't even figure it out.

Yeah, you've posted this editorial from The Hill before. You might want to try something fresher. Mueller's investigation into the Trump's campaign for possible collusion with the Russians is not the same as the Enron investigation or Arthur Andersen investigation. Andersen committed massive levels of accounting fraud. It's not as if Mueller and Co. completely fabricated crimes or destroyed Andersen all on their own. Andersen was largely responsible for the loss of its own integrity and reputation. And the bulk of Powell's op-ed piece was about Weissman, who is not running the Russian investigation. 

Btw: perhaps you didn't read the end of that piece in The Hill very closely. Let me help you out by bolding the last sentence of the bio of the writer of your editorial:
"Sidney Powell (@SidneyPowell1) was a federal prosecutor in three districts under nine U.S. attorneys from both political parties, then in private practice for more than 20 years. She is a past president of the Bar Association of the 5th Federal Circuit and of the American Academy of Appellate Lawyers. A veteran of 500 federal appeals, she published "Licensed to Lie: Exposing Corruption in the Department of Justice." She consulted with Arthur Andersen on appeal and represented one of the Merrill Executives."


Do you really think that Powell is completely unbiased, impressive though her experience may be? 

Finally, most Republicans seemed pretty happy with the choice of Mueller when he was appointed, including Trumpers and Mitch McConnell. 

If you keep rejecting news you don't like with cries of "Fake news! It's all rigged! They just want to get Trump and the truth doesn't matter", then you are one all-day sucker and people like Trump will play you until the end of your days.

If that's the truth, then I will be happy when that comes out. But for all your cries about the love of truth, I don't read any words from you about all the times Trump and his administration have LIED AND LIED AND LIED about meetings and dealings with Russian individuals and members of the Russian government. 

You are stuck in cheerleading mode, and I don't think you'll ever lurch out of it.

it's possible, or even highly likely that cohen or trump could be guilty of something (think about all of the rules and regs)

is it some nefarious collusion with the russians? i don't know, but i think that is probably not the case

i do believe on something this high profile they'll come up with something - guaranteed

will it be legit? this will be the issue (silverglate says obstruction is the feds catch-all) 

the point is that the license/permissions these prosecutors are allowed is so broad and vague that once they focus on you...it's almost a certainty you're getting charged

and people settle because the state literally has infinite resources and you don't, not to mention rolling the dice in court (and federal penalties can be severe)

something will give but either way a lot of emotions will surface

i just hope that people come to their senses and violence is snuffed or minimized
